Welcome to Marble Slab Fudge, LLC.  These Terms and Conditions (“Terms”) govern your use of www.marbleslabfudge.com  (the “Site”) and your purchase of products from us. By accessing the Site or placing an order, you agree to these Terms.

1. About Us

Marble Slab Fudge, LLC is based in Utah, USA. We sell fudge and other food products available for order through our Site.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order on our Site.

3. Products

  • All products are handmade/small-batch and may vary slightly in appearance, size, or weight from photos shown on the Site.

  • We make reasonable efforts to display accurate colors, descriptions, and ingredient information, but we do not guarantee that product descriptions or images are error-free.

  • Product availability is subject to change without notice.

4. Allergen Disclaimer

Our products are made in a facility that also processes [list common allergens, e.g., “milk, tree nuts, peanuts, soy, and wheat”]. While we take care in preparation, we cannot guarantee that any product is completely free of allergens due to shared equipment and facilities. If you have a food allergy or sensitivity, please contact us before ordering.

5. Orders and Payment

  • By placing an order, you agree to pay the listed price plus any applicable taxes.

  • Payment is processed securely at checkout through our payment processor. We do not store full payment card details.

  • We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or product unavailability. If your order is canceled after payment, you will receive a full refund.

6. Pickup Policy

  • Our products do not ship via mail due to their perishable nature. All orders must be picked up at one of our designated pickup locations on a scheduled pickup date, or by special arrangement (see our Shipping Policy for details).

  • It is your responsibility to pick up your order during the scheduled window. 

7. Returns and Refunds

  • Due to the perishable nature of our products, all sales are final once the order has been picked up.

  • If there is an issue with your order (e.g., incorrect item, quality concern), please contact us within 3 days of pickup so we can make it right.

8. Intellectual Property

All content on this Site — including text, graphics, logos, images, and recipes — is the property of Marble Slab Fudge, LLC and is protected by copyright and trademark law. You may not reproduce, distribute, or use our content without prior written permission.

9. User Conduct

When using the Site, you agree not to:

  • Violate any applicable laws or regulations

  • Submit false or misleading information when placing an order

  • Attempt to interfere with the security or functionality of the Site

  • Use the Site for any fraudulent or unauthorized purpose

10. Third-Party Platform (Wix)

Our Site is hosted on the Wix.com platform. Certain features, payment processing, and site functionality are provided by Wix and its third-party partners, and are subject to Wix's own terms of service, in addition to these Terms.

11. Limitation of Liability

To the fullest extent permitted by law, Marble Slab Fudge, LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or purchase of our products. Our total liability for any claim related to a product or order is limited to the amount you paid for that order.

12. Indemnification

You agree to indemnify and hold Marble Slab Fudge, LLC harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Site.

13. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict of law principles. Any disputes arising from these Terms will be resolved in the state or federal courts located in Utah.
